By accessing, downloading, or using Thenema Writer (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Thenema Visuals ("Company," "we," "us," "our") reserves the right to modify these Terms at any time. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
Subject to your compliance with these Terms and payment of applicable fees, Thenema Visuals grants you a limited, non-exclusive, non-transferable, revocable license to use Thenema Writer for your creative, professional, and non-commercial personal projects.
This license does NOT permit you to:
To access Thenema Writer, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your password and account credentials. You agree not to share your account with unauthorized users.
You are solely responsible for all activities conducted under your account. You must notify us immediately of any unauthorized access or security breaches. We are not liable for any unauthorized use of your account.
You must be at least 18 years old to use Thenema Writer. By registering, you represent that you are at least 18 years old.
You retain all intellectual property rights to the Project Data you create and upload to Thenema Writer, including screenplays, character profiles, world-building documentation, and all other creative content.
By using Thenema Writer, you grant Thenema Visuals a limited license to:
This license does NOT permit us to use your Project Data for marketing, publication, public display, or any purpose other than the operation and improvement of the Service. We do not claim ownership of your creative work.
You are responsible for ensuring that your Project Data does not infringe on third-party intellectual property rights, violate applicable laws, or violate these Terms. You agree not to upload illegal, defamatory, obscene, or infringing content.
Thenema Writer is available under two subscription tiers, each with specific features and pricing. Detailed pricing and feature information are available on our website. There is a free trial period that may have usage limitations.
Payment for subscriptions is processed by third-party payment processors (FastSpring, Paddle, Stripe, or similar). You authorize us to charge your payment method for the subscription fee according to your selected billing cycle. All fees are inclusive of applicable taxes, which you are responsible for paying.
Subscriptions renew automatically unless you cancel before the renewal date. Renewal charges will be made to the payment method on file. You are responsible for keeping your payment information current.
For Annual Single Subscriptions:
Refunds are available within 20 days of purchase if you are dissatisfied with the Service.
For Team Subscriptions:
Team Licenses are non-refundable after the 20-day trial period, except in cases of:
Refund requests for Team Subscriptions beyond the trial period are reviewed on a case-by-case basis at Company discretion. Contact support@thenemawriter.com with proof of the issue.
All refund requests must be submitted within 20 days of purchase. Refunds are issued to the original payment method within 5–7 business days.
We reserve the right to change subscription pricing with 30 days notice. Price changes take effect upon your next renewal date. If you do not agree to price changes, you may cancel your subscription.

AI features in Thenema Writer are designed to assist and enhance your creative process, not to replace your judgment. AI suggestions may contain errors, inaccuracies, or inappropriate content. You are solely responsible for reviewing, editing, and deciding whether to use any AI-generated suggestions.
Your Project Data is NOT used to train or improve AI models. We do not use your creative work to develop general-purpose AI systems or publish it for AI training datasets.
When you share a project with collaborators, you grant them access to view, edit, or comment on Project Data depending on the permissions you set. You are responsible for:
Thenema Visuals is not responsible for disputes arising from collaboration. Collaborative relationships and intellectual property agreements between you and your collaborators are outside the scope of these Terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THENEMA VISUALS SHALL NOT BE LIABLE FOR:
OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID TO THENEMA VISUALS IN THE 12 MONTHS PRECEDING THE CLAIM.
THENEMA WRITER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. While we implement security measures, we cannot guarantee absolute data protection.
You may terminate your account and subscription at any time by accessing your account settings or contacting support. Upon termination, your subscription will continue until the end of the current billing period.
We may terminate your access to the Service immediately, without notice, if you:
Upon termination, you lose access to your account and any stored Project Data.
You agree to indemnify and hold harmless Thenema Visuals and its officers, employees, and agents from any claims, damages, or costs arising from your use of the Service, violation of these Terms, or infringement of third-party rights through your Project Data.
These Terms are governed by the laws of Kenya, without regard to conflict of law provisions. However, for users in the EU/UK, applicable consumer protection laws (including GDPR) take precedence where they provide greater protections.
Before pursuing formal action, both parties agree to attempt good-faith resolution through email communication at support@thenemawriter.com within 30 days.
